What is California SB 1383?

 

In 2016, California passed Senate Bill 1383, California’s Short-Lived Climate Pollutant Reduction Strategy. This bill aims at reducing methane and other greenhouse gas emissions across the state with the goal of meeting two targets by 2025

• 75% less organic waste to landfills

• 20% of unsold, edible food donated to food recovery organizations

​

CA SB1383 is overseen by CalRecycle, however, implementation and enforcement of the law is managed by city, county, or special districts. Each jurisdiction will implement ordinances, requirement, and other regulations as necessary to achieve compliance.

Who Must Comply with CA SB1383?

​

• Tier 1 Food Generators – enacted January 1, 2022

  • Wholesale Food Vendors

  • Food Service Providers

  • Food Distributors

  • Grocery Stores (over 10,000 sq ft)

  • Supermarkets

• Tier 2 – January 1, 2024

  • Restaurants (250 or more seats or total size of equal to or greater than 5,000 sq ft)

  • Hotels (on-site food facility and 200 or more rooms)

  • Health Facilities (on-site food facility or 100 or more beds)

  • Large Venues (seats or serves an average of more than 2,000 individuals)

  • Large Events

  • State Agencies (cafeteria with 250 or more seats or size equal to or greater than 5,000 square feet)

  • Local Education Agency (on-site food facility)
